COMMISSION REFUND POLICY
If you decide after placing a commission that you would like a refund or are worried about status, please message me before taking action. I will refund you in full if I have not yet started work on your commission.
If I have started work then I will give you a partial refund depending how far I got.
I will not give refunds after I have finished your commission. If you are unhappy with it, message me and we can work something out. I will not redraw the piece but I am happy to correct minor mistakes that I have made due to my own fault.

By purchasing (or owning) any artwork, designs, or services from me, you are agreeing to have read and agreed to the terms below.

Anyone who breaks these rules or any specific rules stated elsewhere will be warned and will not be allowed to purchase from me for a given amount of time determined by the extent of the offense. The ban may be permanent if deemed severe enough and a private blacklist will be kept to keep track of offences.

DISCLAIMER// If purchasing a product/service of any sort with someone else's money/paypal/card or a shared account, I expect to be informed and shown proof that this transaction is approved by all parties. I am not to be held responsible if I am not informed. If you buy a product/service from me, you and all parties involved will have read and agreed to this.

The guidelines below apply to everyone regardless of purchase or not.
Never claim any of my art or designs as your own.
No one has the right to trace, heavily reference or use my art as a pose reference.
My art cannot be used for monetary gain or promotion. I do not offer commercial work as of this time.
If you don't agree with or can't afford a price, don't buy it.
All my prices will always be displayed in USD (United States dollar).
I will only accept USD via Paypal or sometimes Deviantart points.
I have the right to refuse any sale for any reason.

REPOSTING
Only by the owner of said art or character can repost/upload to any site only with proper credit.
Proper credit consists of physically linking back to my social media on one site or another. Simple text will not be counted- it must be hyperlinked in some way if possible. Art used on a personal page/as banner/icon are the only acceptations to the hyperlink rule, hyperlink is preferred but simple text is still required somewhere visible please.
If the depicted character/s is/are passed off to someone else then the full resolution images should be sent to the new owner.
My TH is STARBITT if that is your site of choice. Other social medias are linked on my page.
Art may be reposted publicly only in 50% of the full resolution or less. I draw on very large canvases to say the least and this file will typically be provided to you by me.
Pixel art doesn't apply to this rule.
You may privately link full resolution art if you are commissioning art of the character and it's needed as a reference.
All watermarks must be present to help protect from theft.
If reselling a character that has art commissioned from me, you may only add the equivalent of 50% of what was originally paid to me for the commission to the resale value. If the art has no monetary purchase value then a price cannot be added to the resale price.
You may not use my art as a brand for yourself.

A D O P T S / A U C T I O N S / O W N I N G A D E S I G N

PAYMENT + PLANS
Please refrain from bidding if you have unfinished purchases from another auction or adopt.
Payment should be received within 24 hours, but can be negotiated as long as communication is present and clear.
Payment plans are available for prices over $300 with a nonrefundable down payment of at least $100- this is to protect myself from false bids.
General payment plan should be made within 3 weeks unless communicated otherwise. I'm willing to negotiate so long as communication is consistent and clear.
Refunds are not available and are not negotiable once full payment has been received.
Ownership is only permitted when payment is completed and you will only then be given the full image.

OWNING A DESIGN
Once payment is cleared, the design belongs to you and you can you can use them for whatever you wish.
Designs do not have a set gender, history, or personality. You do not have to use my canons for closed species.
You may trade and gift a design unless stated otherwise.
Co-ownership is not allowed.
I retain the rights to the design and the use of the original artwork any anyway I would like to use it as art examples or post them elsewhere.
If reposting/uploading an image I've made to another site (such as TH or FA) see the section above labeled "REPOSTING" which pertains to designs.
Every single image drawn of a design made by me does not require credit, just the remade refs/original images are fine.
It's not mandatory, just a perk, but I really love seeing what you do/what art is made with the designs made by me! Feel free to share! n_n

EDITING
Minor edits may be made to the original image made by me (such as adding piercings, changing eye color, fix a tiny goof I may have made) but keep the original unedited file. Anything more than minor must be asked for permission. If you are worried, ask me.
Cropping for icons/banners/etc is fine.
You may change up to 20% of the design on a redrawn image but it should still look like the original design.
Any clothes/accessories can be added, negated, or changed unless stated otherwise. This does not contribute to the percentage of the design that's changed.

RESELLING/CHANGING HANDS
You must have owned the design for at least 3 weeks before reselling/changing hands.
You must have the full resolution unedited image of the adopt to sell/trade/gift it.
Keep this file safe and be sure to pass it on to the next owner. Do not post the full res image online. If you do not have the full resolution unedited image of the adopt, then there is no full proof you own the character.
You may privately link the full resolution to someone if you are getting a commission from them so they can have it as a ref, if needed.
You cannot sell it for more than you paid if you are the original owner if there is no additional art made.
You may add the cost of extra art purchased by you yourself depending on said artist's TOS. Art that was not paid for in monetary value can not be added to the resale price. (ie. gift art, art trades, etc)
You may add the value of your own art made but please be mindful of the rule above and consider your own TOS. For example if you draw a sketched headshot please don't add something like $50 to the price. Please keep everything within reason.
Basically don't profit off my designs even if they were cheap or expensive, simple.
You can only resell a design for what you paid via a resale.
If the design was sold to you at a lower value, you can now only sell the design at the lesser value in the future. If it was a sale that had the addition of other items/designs or art, you may still only resell if for the monetary price that was paid...
UNLESS there is additional art that was paid for. Same rules apply to the bullet points above. For example, say the design originally sold for $100 to the original owner and was sold to you at the price of $50 along with another character. You may now only resell it for $50 if no additional art you yourself purchased for it.
You cannot resell a design you receive via trade or gift.
You cannot auction off a design from me.


TRANSFERRING
(04.23.19 onward)
Please notify me via this journal when transferring a design and pass this TOS on to whoever will receive the design.
I am not to be held responsible if you have unfortunately been scammed from a fake reseller and I cannot refund you. This TOS is designed to prevent this as much as possible. It's happened before so please stay vigilant.

C O M M I S S I O N S

PAYMENT
The commission won't be started unless I have received payment in full.
Deadlines are negotiable but must be discussed before payment is sent.
Rush fees may apply depending on the requested deadline.
Prices shown are flexible and will go up if I'm given a complicated character/design/prop.
Payment plans are not offered as of this time.

GENERAL
I only take visual references.
Commissions will be put into a queue once payment has been received and queue will generally be worked on in order.
Commissioner will receive the full resolution image. A transparent version can be given at request if available.
If information is not given properly, I am not to be held responsible for errors in designs or compositions.
The commissioner may make personal minor edits. Anything more than minor must be asked for permission. If you are worried, ask me.
Art may be used by the commissioner for any personal uses as long as there is not monetary gain.
For example, I've been asked if works can be used to put on a personal t-shirt or be made into a keychain, as long as those items are not sold or used as a trade to others then go for it! I think things like that are really cool, just let me know beforehand please. I'd like things similar to these to only happen with the original owner of the commission.
